The Pioneer : Producing fake MBA degree certificates for marriage proved costly for a man and his family when a sessions court dismissed the order passed by a trial court and ordered police to register a case against the accused.
“This observation of the Metropolitan Magistrate that no further evidence was required to be collected and the charges can be proved by leading evidence cannot be legally sustained,” said Additional Sessions Judge (ASJ) Sanjeev Aggarwal. Consequently, setting aside the order of the Metropolitan Magistrate, the court directed the MM to further direct the concerned Station House Officer of police station Prashant Vihar to register an FIR, on the complaint of the complainant. Cases of cheating and getting admissions on the basis of fake degrees and certificates in the educational institutes have come to light several times. But this time, a city court has received a complaint in which the accused married a girl by procuring fake professional degree of MBA. In the present case, the complaint has been instituted by the complainant Yogesh Puri, father of the girl. Puri has made a complaint against his son-in-law Akshay Sadana and his parents. Puri alleged that Akshay misrepresented himself to him as well as his family that he is a qualified MBA and on the basis of the said representation, he obtained his consent as well as consent of his family for marriage. Later on after the marriage, it was discovered that Akshay is not holding any such degree. ASJ Aggarwal said, “The order passed by the Metropolitan Magistrate cannot be legally sustained, as in this case Puri has also made allegations in his complaint that certain degrees produced to him by Akshay at the time of marriage were later on found to have been forged and fabricated and Puri has also filed the certificates in this regard from the concerned Registrar of Chaudhary Charan Singh University, Meerut, who had made endorsement on the said testimonials, that the said testimonials were never issued from the CCS university and were fake in nature.” The court had ordered the police to register a case against five persons including Akshay Sadana, Abha and Vijay Sadana (Parents of Akshay), Ankita and Naveen Wadhwa (sister and brother-in-law of Akshay). The court said that in the present case, field investigation would be required by the police to unearth the fact, as to who are the persons responsible for preparing the said fake degrees and fake testimonials, and who had also forged the seal of the university on the same which are the facts which can not be said to be within the knowledge and reach of the complainant Puri, which can only be discovered by police, during the field investigation. |
